I. GENERAL PRINCIPLES

This operating regulation includes the terms and conditions for operating and using services on the website https://devworkx.com.

Job information posted and transacted on https://devworkx.com must fully comply with all relevant legal regulations. Individuals or organizations posting recruitment information must be fully responsible before the law for the information they post.

Candidate profile information posted must be authentic, and the account owner must be fully responsible for the accuracy and voluntariness of the personal information shared.

Members interacting on https://devworkx.com must do so in a spirit of honesty and mutual respect.

All service activities on https://devworkx.com are conducted publicly and transparently, ensuring users' rights and interests.

II. GENERAL REGULATIONS

Employer: is a business that needs to post job listings, search for and recruit candidates on https://devworkx.com.

Broker: is an organization or individual who introduces job-seeking candidates to Employers, on the basis that the candidate is a suitable match for the Employer's needs.

Candidate: is an individual seeking employment who applies through job listings on https://devworkx.com.

Advertiser: is a business or organization that needs to post advertisements related to recruitment activities in accordance with applicable law.

Member: is an individual or organization wishing to purchase or use the services and features of this Website. Members must register and declare their personal or business information in accordance with the law, and may only use the website's services after officially completing the registration process as recognized by the website management board.
Members using this website must agree that:

You are an individual and/or a business entity.

You have full civil legal capacity.

At any time and place you access this website, you must fully comply with all terms of this Regulation.

You must protect your password and monitor all information related to your account. You understand and agree that you are responsible for any use of your account by anyone you allow access to it.

The information you provide to the management of https://devworkx.com is accurate, complete, and truthful.

III. TRANSACTION SECURITY ASSURANCE

Devworkx.com establishes the following transaction security mechanism:

Member Information Management: When registering on https://devworkx.com, members must provide complete relevant information and are fully responsible for such information. This includes legal status information for organizational members. Such information will be incorporated into the management database of https://devworkx.com.

Upon becoming a Member on https://devworkx.com, the member must commit to the credibility and accuracy of all job-related information as stated in the posted title and description.

Complaint Mechanism for Members: Customers have the right to submit complaints about Members/Employers who post inaccurate information to https://devworkx.com. Upon receiving such feedback, https://devworkx.com will verify the information and, if confirmed, will take timely measures to protect Members' interests based on the severity of the violation.

IV. PROTECTION OF MEMBERS' PERSONAL INFORMATION

Purpose and Scope of Data Collection

Data collection on the IT community platform https://devworkx.com primarily includes: email addresses, phone numbers, usernames, login passwords, and customer (member) addresses.
This information is required by https://devworkx.com when members register for services, and is used to contact and confirm registrations in order to protect consumer rights.

Members are solely responsible for maintaining the security and confidentiality of all activities conducted under their username, password, and email address.
Additionally, members are responsible for promptly notifying the administrators of https://devworkx.com of any unauthorized use, abuse, or security violations involving their credentials, so that appropriate measures can be taken.

Scope of Information Use

https://devworkx.com may also use collected information to notify candidates about products and services offered by https://devworkx.com or its partner companies, or to seek your feedback on current or potential new products and services.

https://devworkx.com may use your contact information to send you emails or other notifications about updates on the recruitment website. The content and frequency of these communications will vary depending on the information https://devworkx.com has about the candidate. Additionally, upon registration, businesses may opt to receive information, notices, and promotional programs including, but not limited to, free newsletters from https://devworkx.com on topics you may be particularly interested in. Any feedback submitted to https://devworkx.com becomes the property of https://devworkx.com, which may use such feedback (e.g., experiences, success stories) for marketing purposes or to contact candidates for further information.

Data Retention Period

Members' personal data will be stored until a deletion request is made or until the member logs in and performs the deletion themselves. In all other cases, members' personal information will be secured on the servers of https://devworkx.com.

Methods and Tools for Consumers to Access and Edit Their Personal Data

https://devworkx.com provides businesses with the means to ensure their information is accurate and up to date. Businesses have the right to edit their data by logging into https://devworkx.com and navigating to the account section to make adjustments easily.

If a registered user forgets their password, they may recover it by using the "Forgot Password" feature. Click the button on any login page to request a password reset. Devwork cannot provide your password through any other means.

Mechanism for Receiving and Resolving Consumer Complaints Regarding Misuse of Personal/Business Information

Devwork commits to protecting Members' business information, using all reasonable efforts and appropriate measures to keep information provided by Members secure and protected from unauthorized access. However, in cases where unauthorized access occurs beyond our control, Devwork shall not be liable in any form for any claims, disputes, or damages arising from or related to such unauthorized access. Members understand and agree that Devwork may disclose to third parties, on an anonymous basis, certain aggregated information from Member registration profiles. Devwork will not disclose to any third party your name, address, email address, or phone number without your prior consent, except as necessary or appropriate to comply with applicable law or in legal proceedings where such information is relevant. Devwork does not sell or rent Members' personal information to third parties for marketing purposes without Member consent. We use Member information as described in the Privacy Policy of https://devworkx.com. We consider protecting user privacy a fundamental community principle. https://devworkx.com stores and processes Member information on physically secured computers and technological security devices. Members may access and modify the information they have provided to https://devworkx.com and opt out of certain communications by logging into their Member account.

We commit to receiving and processing reports from registered members regarding the misuse of collected information. Response time is within three (03) business days.

V. MANAGEMENT OF HARMFUL CONTENT

1. Measures for Managing Posted Listings

The website administration team (hereinafter referred to as "admin") continuously monitors user postings for compliance.

Listings that violate the regulations will be removed without prior notice.

- Unclear listings (missing diacritics, vague contact information, unclear content, etc.) will receive a notification from admin requesting corrections. If not corrected within 2 days, the listing will be removed by admin.

Listings showing signs of fraud or legal violations will result in the immediate locking of the associated account.

Each listing has a violation reporting feature that allows users to report directly to the site admin.

2. Regulations on Prohibition of Posting Illegal Information and Images

All the following regulations apply to the pre- and post-publication review process of the administration of https://devworkx.com to detect Members who violate regulations, with the aim of creating a safe, healthy, and fair environment. Admin advises Members to carefully review the regulations before posting any information to avoid unintentional violations. The following situations must be avoided:

Unauthorized use of another person's account.

Posting false or inaccurate biographical information, or information that is not the Member's own genuine job application (for individuals seeking full-time or part-time employment).

Using job application data from https://devworkx.com for any purpose other than recruiting candidates as an Employer, including but not limited to using data from this database to sell or introduce any products or services; sending letters, emails, making calls, or engaging in other forms of communication to promote products or services to other Members of https://devworkx.com.

Copying or modifying website content including copyrights, logos, and trademarks.

Using other users' information without their consent.

Posting, sending, or transmitting illegal, threatening, defamatory, obscene, offensive, or otherwise inappropriate content, including but not limited to content that encourages criminal behavior, creates civil liability, or violates local, national, or international law.

Posting, sending, or transmitting information, software, or other materials that violate or infringe the rights of others, including materials that infringe privacy or publicity rights, or materials protected by copyright, trade names, or other proprietary rights, or derivative works without authorization from the owner or rightful holder.

Posting, sending, or transmitting information, software, or materials that contain viruses or other harmful components.

Altering, damaging, or deleting any content or other materials not owned by you, obstructing others' access to https://devworkx.com, or interfering with the interactions of other users while using the website's services.

Posting, announcing, or speaking on behalf of a business, organization, or association you are not authorized to represent.

Advertising, promoting, or propagating products, goods, or services that are legally prohibited.

Using https://devworkx.com, including but not limited to its services and products, for any illegal purpose, including but not limited to violating any rule, policy, or guideline of your Internet service provider or online services.

Using https://devworkx.com to spread propaganda, distort, or incite against the Socialist Republic of Vietnam; incite violence, war propaganda, hatred, obscenity, crime, social vices, superstition, undermine national customs, or incite religious and ethnic hatred.

Using https://devworkx.com to disclose state secrets, military secrets, security, economic, diplomatic, or other legally protected confidential information.

Using https://devworkx.com to slander, defame, or insult the reputation of organizations or the honor, dignity, or reputation of individuals.

Referring to political or religious matters.

Accounts impersonating https://devworkx.com or administrative roles such as "admin," combined with profile pictures using the Devwork logo, are considered fake accounts.

Usernames that are misleading, inflammatory, or violate Vietnamese community standards.

Profile pictures of recruiting organizations that infringe on the intellectual property of other organizations.

Unclear contact information including: contact name, phone number, address, or email address.

Job titles that do not correspond to the actual recruitment position, are unclear, or are misleading.

Job descriptions or recruitment information using inappropriate language that violates https://devworkx.com regulations or Vietnamese law and community standards.

3. Industries Not Permitted for Recruitment Postings

The website only posts IT industry job listings and candidate profiles. Businesses may not exploit the platform to post listings for the following illegal services:

Trading in military weapons, equipment, technology, ordnance, military or police vehicles; military uniforms and supplies for armed forces; components, parts, accessories, materials, and specialized equipment or technology used in their manufacture.

Trading in narcotic substances listed in Appendix 1 of applicable law, except for use in analysis, testing, scientific research, medical use, or criminal investigations as authorized by competent state authorities.

Reactionary, depraved, superstitious cultural products, or products harmful to aesthetic education and character development.

Trading in dangerous toy fireworks or toys harmful to children's character development and health, or detrimental to social security, order, and safety (including electronic game programs).

Trading in veterinary drugs or plant protection products that are banned or not yet permitted for use in Vietnam under applicable ordinances.

Trading in wild plants and animals (including living specimens and processed parts) listed under international treaties to which Vietnam is a signatory, as well as rare and precious species on the prohibited exploitation and use list.

Trading in banned aquatic products, aquatic products with toxic residues exceeding permissible limits, or aquatic products with natural toxins dangerous to human life.

Trading in fertilizers not on the list of products permitted for production, trading, and use in Vietnam.

Trading in plant varieties not on the list of approved varieties; plant varieties harmful to agricultural production, human health, the environment, or ecosystems.

Trading in particularly hazardous minerals.

Trading in imported scrap that causes environmental pollution.

Trading in human medicines, vaccines, biologics, cosmetics, chemicals, and disinfectant products for household and medical use not yet approved for use in Vietnam.

Trading in medical equipment not yet approved for use in Vietnam.

Trading in food additives, food processing support substances, micronutrients, functional foods, high-risk foods, irradiation-preserved foods, or genetically modified foods not yet approved by competent state authorities.

Trading in products or materials containing amphibole-group asbestos.

Trading in smuggled cigarettes, cigars, and other finished tobacco products.

Trading in prostitution services, organizing prostitution, or trafficking in women and children.

Trading in gambling organization services in any form.

Trading in secret investigation services that infringe on the interests of the state, or the rights and legitimate interests of organizations and individuals.

Trading in international marriage brokerage services for profit.

Trading in international adoption brokerage services for profit.

4. Review Methods and Frequency for Detecting and Handling Violations

New regulations on https://devworkx.com, based on market analysis, community feedback, and operational issues, will be continuously updated by the administration board in accordance with Clause 3, Article 38 of Decree 52/2013/ND-CP (5 days' advance notice required).

All listings must pass direct review by the administration board before being displayed on the website. Only listings that comply with https://devworkx.com regulations will be activated and published.

VI. RESPONSIBILITY IN CASE OF TECHNICAL ERRORS

Devwork commits to ensuring the safety and stability of the entire technical system. However, in the event of an incident caused by Devwork's fault, we will immediately take measures to protect the interests of service users. When conducting transactions on the website, members are required to follow the prescribed procedures. Devwork commits to providing the best service quality for all participating members. In the event of technical errors, software failures, or other objective issues that prevent a Member from operating, the Member should notify the administration by phone at 0888948269 or by email at cskh@devwork.vn. However, https://devworkx.com will not be responsible for resolving cases where Member notifications do not reach the administration due to technical errors, connection failures, software issues, or other errors not caused by the administration.

VII. RIGHTS AND OBLIGATIONS OF DEVWORK

1. Rights of the Management of https://devworkx.com

The IT community personnel connection system will provide services to participating members after they have completed all required procedures and conditions set forth by https://devworkx.com.

If there is reasonable basis to prove that a member has provided inaccurate, misleading, incomplete, or unlawful information, or information that violates Vietnamese cultural standards, Devwork has the right to refuse, suspend, or terminate the member's right to use the services. Devwork may terminate membership and the right to use one or all services, with at least one (01) month's notice, in cases where the member violates Devwork's regulations or engages in conduct that adversely affects business operations on Devwork.

Devwork will consider terminating a member's service usage rights and membership if the member has not engaged in any transactions or information exchange on Devwork for a continuous period of three (03) months. Members wishing to continue membership and have their service rights restored must re-register according to Devwork's forms and procedures.

Devwork may immediately terminate a member's service rights and membership if Devwork discovers the member has gone bankrupt, been convicted, or is currently serving a sentence; if the member's continued activity could expose Devwork to legal liability; or if the member engages in fraud, impersonation, market disruption, or conduct harmful to other Devwork members, or activities in violation of applicable Vietnamese law. Upon termination of membership and service rights, all certificates and rights granted to the member shall be automatically void and terminated.

Devwork retains copyright over its services and content in accordance with Vietnamese intellectual property protection laws. All logos and content in various languages are the property of Devwork Joint Stock Company. Any unauthorized copying, use, or distribution of these proprietary rights is strictly prohibited.

Devwork reserves the right to modify service pricing and payment methods during the service provision period based on our needs and capabilities, and will notify members at least one (01) month in advance.

2. Obligations and Responsibilities of Devwork

Devwork is responsible for establishing and implementing a "verification and monitoring mechanism to ensure that information provided by recruiters on the e-commerce platform is accurate and complete," as required by Clause 4, Article 36 of Decree 52/2013/ND-CP.

Devwork is responsible for building the Website, including research, design, procurement of hardware and software, internet connection, and policy development in support of Devwork's operations within permitted conditions and scope. Devwork will deploy and collaborate with partners to build service systems and utility tools to facilitate transactions for participating members and users on Devwork.

Devwork is responsible for receiving reports from members in the event of disputes between job seekers and Employers. The administration board will carefully consider such reports and, depending on the severity, will take appropriate measures to protect members' interests.

Devwork will prevent and remove product/service listings that fall under prohibited goods and services categories as required by law, and restricted goods in accordance with Clause 1, Article 3 of Circular No. 47/2014/TT-BCT.

Devwork will remove from the website any recruitment listings or candidate profiles that do not comply with the website's terms of service or that violate the law, upon detection or upon receiving credible reports.

Devworkx.com requires sellers of conditionally licensed goods and services to provide the appropriate business license certificate for those goods/services (where required by law).

Devwork is responsible for building and maintaining a knowledge base covering: e-commerce/electronic transactions, domestic and international commercial legal frameworks, foreign markets, and news related to our operations. Devwork will conduct promotional and outreach activities in foreign markets within permitted scope and conditions, helping to expand and connect job/candidate opportunities and develop international markets for Devwork members.

Devwork will make every effort within its means to maintain normal operations and address incidents such as: mechanical failures, software errors, internet connection failures, personnel issues, social disruptions, natural disasters, power outages, or decisions by government authorities or related third parties. However, if such incidents occur beyond our control and constitute force majeure causing damage to members, Devwork shall not be jointly liable.

Devwork will take timely action upon detecting or receiving reports of illegal business activities on the e-commerce platform.

Devwork will support state management authorities in investigating illegal business activities, providing registration information, transaction history, and other documents related to individuals or entities engaged in unlawful conduct on the e-commerce platform.

Devwork will publicly disclose its dispute resolution mechanism for transactions conducted on the e-commerce platform. When a customer on the platform has a dispute with a seller or suffers harm to their legitimate interests, Devwork will provide the customer with seller information and actively support the customer in protecting their lawful rights and interests.

VIII. RIGHTS AND RESPONSIBILITIES OF MEMBERS

1. Rights of Members on Devworkx.com

1.1. Members who are Employers

Upon registering as a Member of https://devworkx.com and being approved by Devwork, the Member will be issued a unique username and password to log into their account. After logging in, the member may use the website's features and services, including:

Creating and posting job listings or purchasing service packages on the website, and viewing applicant information for their posted listings.

Members will be guided by Admin on how to use the tools and features available for building recruitment listings and utilizing utility services on https://devworkx.com.

Members may be eligible for promotional policies offered by Devwork or third-party partners on https://devworkx.com. Such policies, if available, will be posted directly on https://devworkx.com or sent directly to Members.

Members have the right to provide feedback and suggestions to https://devworkx.com. Suggestions may be sent directly by letter or email.

1.2. Members who are Brokers

Upon registering as a Member of https://devworkx.com and being approved, the Member will be issued a unique username and password to log into their account. After logging in, the member may use the website's features and services, including:

Creating and uploading profiles of candidates that match Employer requirements.

The right to update and edit company introduction information on the website at any time.

Members will be guided by Admin on how to use the tools and features for updating candidate listings for interested Employers, and utilizing utility services on https://devworkx.com.

Members may be eligible for promotional policies offered by Devwork or third-party partners. Such policies, if available, will be posted directly on https://devworkx.com or sent directly to Members.

Members have the right to provide feedback and suggestions to https://devworkx.com. Suggestions may be sent directly by letter or email to Devwork.

2. Obligations and Responsibilities of Members on Devworkx.com

2.1. Members who are Employers

Members are solely responsible for the security, storage, and all activities conducted under their username, password, and email address. Members are obligated to promptly notify https://devworkx.com of any unauthorized use, abuse, or security breach involving their credentials so both parties can cooperate to address the issue.

Members commit that all information provided to https://devworkx.com and all information posted on https://devworkx.com is accurate and complete. Members agree to keep and update all information on https://devworkx.com to be current, accurate, and complete.

As users, Members are responsible for their private communications and for the results of their postings. Members are not permitted to: post copyrighted content unless they are the copyright owner or have been authorized to do so; post content that reveals trade secrets unless they own or have permission to do so; post content that infringes any intellectual property rights of others or violates others' privacy or public rights; post content that violates community standards, is defamatory, threatening, harassing, insulting, hateful, or interferes with other users; post off-topic or inappropriately themed content; post pornographic images or content; post advertising or solicit commercial transactions; or post content containing viruses, trojans, malware, or other malicious programs intended to destroy, interfere with, obstruct, deceive, or hijack any system, data, or information.

Members are solely responsible for the content and images of their business information and all other information, as well as the entire transaction process with partners/candidates on https://devworkx.com.

Members must comply with applicable laws on payment, advertising, promotions, intellectual property protection, and other relevant legal regulations when participating in the e-commerce platform.

Members commit and agree not to use the services of https://devworkx.com for any illegal, unreasonable, fraudulent, threatening, unauthorized information-gathering, destructive, or virus-spreading purposes that could damage the system, configuration, or data transmission of https://devworkx.com. In case of violation, Members shall be held legally responsible for their actions.

Members commit not to alter, modify, copy, transmit, distribute, provide, or create similar tools to the services provided by https://devworkx.com for any third party without Devwork's consent.

Members must not take actions that damage the reputation of https://devworkx.com in any form, such as causing disunity among Members through the use of a second registration account, through a third party, or by spreading information harmful to the reputation of https://devworkx.com.

2.2. Members who are Brokers

Members are solely responsible for the security, storage, and all activities conducted under their username, password, and email address. Members are obligated to promptly notify https://devworkx.com of any unauthorized use, abuse, or security breach involving their credentials so both parties can cooperate to address the issue.

Members commit that all candidate information provided to Employers on https://devworkx.com and posted on https://devworkx.com is accurate and complete.

As users, Members are responsible for the outcomes of their postings. Members are not permitted to post inaccurate information or profiles of candidates who are not actively seeking employment, which would waste the time of all parties involved.

Members are solely responsible for the content and images of their business information and all other information, as well as the entire transaction process with partners/candidates on https://devworkx.com. Any information that the candidate does not wish to disclose must be respected and complied with by the Member.

Members must comply with applicable laws on payment, advertising, promotions, intellectual property protection, and other relevant legal regulations when participating on Devworkx.com.

Members commit not to alter, modify, copy, transmit, distribute, provide, or create similar tools to the services provided by https://devworkx.com for any third party without Devwork's consent.

Members must not take actions that damage the reputation of https://devworkx.com in any form, such as causing disunity among Members through the use of a second registration account, through a third party, or by spreading information harmful to the reputation of https://devworkx.com.

IX. APPLICABLE TERMS

Any disputes arising between Devworkx.com and Members will be resolved through negotiation. If a mutually satisfactory agreement cannot be reached, either party has the right to bring the matter to a competent court for resolution.

Devwork has the right to amend and update these Regulations to reflect operational realities and is responsible for announcing such changes on https://devworkx.com for members' awareness. Amended Regulations take effect from the date of notification and will be announced at least 5 days in advance in accordance with Clause 3, Article 38 of Decree 52/2013/ND-CP.

XII. COMMITMENT CLAUSE

We commit to complying with all terms and conditions set forth above.
